Michigan’s Expungement Law: Clean Slate Act
Michigan’s expungement law underwent major changes in 2021 with the Clean Slate Act, significantly expanding who qualifies for relief.
✅ Key Provisions of Michigan’s Expungement Law:
- Up to 3 felony convictions and unlimited misdemeanors may be eligible to be set aside.
- Certain assaultive crimes, crimes punishable by life, and CSC offenses are excluded.
- Waiting periods apply:
- 3 years after last conviction or release for eligible misdemeanors
- 5 years for one eligible felony
- 7 years for multiple felonies
- Marijuana convictions for now-legal conduct are eligible for expedited expungement.
- Automatic expungement is being phased in for certain offenses without needing a petition.
🔷 Note: Some offenses — like traffic offenses causing death or injury, CSC, and some weapons charges — are not eligible for expungement.
